These Terms of Use (“Terms”) govern your use of the Highness mobile application (“App”) and related websites and services offered by Highness (“we”, “us”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App and services

Highness is a personal diary tool for logging sessions and related information. The App may include local storage, optional online features, optional iCloud functionality, subscriptions, maps, analytics, and reference data, as described in our Privacy Policy.

2. Eligibility and local laws

You are responsible for complying with the laws that apply to you, including laws related to cannabis, privacy, and age limits. You must be old enough to lawfully use the App in your region. The App may not be legal for all users in all jurisdictions, and we do not warrant that your use of the App is lawful where you live.

3. Not medical or professional advice

The App is not medical, therapeutic, or professional advice. Nothing in the App diagnoses, treats, or prevents any condition. Always consult qualified professionals for health decisions.

4. Your content and data

You are responsible for the content you enter and for maintaining the security of your device and account credentials, where applicable. You grant us only the rights necessary to operate the features you use, such as storing, syncing, backing up, displaying, or processing content you submit, as described in the Privacy Policy.

5. Subscriptions (Highness Plus)

Certain features may require an active Highness Plus subscription or a prior qualifying purchase, as shown in the App.

  • Billing. Payment is charged to your Apple ID. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Price changes. If Apple or we change pricing, Apple’s subscription rules apply. You can review upcoming charges in your Apple ID subscription settings.
  • Free trials and introductory offers. If offered, any trial or introductory period converts to a paid subscription at the then-current price unless you cancel before renewal, as shown at purchase time in the App Store flow.
  • Cancellation. You can cancel in Settings > Apple ID > Subscriptions on your device, or via the App Store account/subscriptions page.
  • Refunds. Refund requests are handled by Apple according to App Store policies.

6. Apple App Store terms

These Terms are between you and Highness, not Apple. Highness, not Apple, is solely responsible for the App, its content, maintenance, support, and any claims relating to the App or your possession and use of it, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims.

Your license to use the App is personal, non-transferable, and limited to Apple-branded products you own or control, as permitted by the App Store usage rules. Apple has no obligation to provide maintenance or support for the App.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to App Store rules. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

For App Store distribution, you represent that you are not located in a region subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” region, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

7. Acceptable use

You agree not to misuse the App, including by attempting to interfere with security, reverse engineer the App except where permitted by law, or use the App to violate law or third-party rights.

8. Intellectual property

The App, its design, trademarks, and content we provide are owned by Highness or our licensors. We grant you a personal, non-exclusive, non-transferable license to use the App in line with these Terms and the App Store rules.

9. Third-party services

The App may rely on third parties, such as Apple, iCloud, analytics providers, payment processors, mapping services, hosting providers, or data providers. Their terms and privacy policies may apply, and you agree to comply with applicable third-party terms when using the App.

10. Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Highness and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App. Where liability cannot be excluded, our total liability for claims relating to the App is limited to the amount you paid us for the App or subscriptions in the twelve (12) months before the claim, except where mandatory law does not allow such a cap.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.

12. Indemnity

You agree to indemnify and hold harmless Highness from claims arising out of your use of the App, your content, or your violation of these Terms, to the extent permitted by law.

13. Changes to the App and Terms

We may modify the App or these Terms. Material changes will be indicated by updating the “Last updated” date. Continued use after changes constitutes acceptance. If you do not agree, stop using the App.

14. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access if we reasonably believe you violated these Terms or pose a risk to the service or others.

15. Governing law

If you are a consumer in the European Economic Area or the United Kingdom, you benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms limits those rights.

Otherwise, these Terms are governed by the laws of Portugal, without regard to conflict-of-law rules, and the courts of Portugal have jurisdiction, except where mandatory law requires otherwise.
